Chapter 7 bankruptcy

Chapter 7 bankruptcy can be an easy, affordable, and low-risk way to discharge debt and jumpstart your financial future. In a Chapter 7 bankruptcy proceeding, individuals are able to eliminate most forms of debt without a repayment plan, preserve important assets like homes, cars, and retirement accounts, and discharge debt without caps.

However, not all filers will qualify for Chapter 7. To be eligible, your income must be under the Colorado state median income. Further, you must pass a means test to determine there is no possibility for repayment, provided your debt is consumer debt. Those without consumer debt, disabled military personnel, or with debt accrued during active service are exempt.

Chapter 13 bankruptcy

For those who do not qualify for Chapter 7 bankruptcy, Chapter 13 may be an option. Also known as a reorganization bankruptcy, Chapter 13 filings utilize a payment plan to ensure all or most creditors are paid back to some degree, even if the settled amount is far less than what you owe. While some assets may be forfeited in this process, Chapter 13 can eliminate certain tax debts, cure defaults on car loans and mortgages, and remove certain liens. Further, Chapter 13 bankruptcy stays on your credit report for a shorter duration.

Chapter 13 bankruptcy eligibility requires the ability to make payment as well as meeting debt limitations on both secured and unsecured debt.
